店主捉贼反被起诉

Charges against the Chinatown grocer who tackled, bound and held a man stealing from his store still stand – and Wang (David) Chen won't find out for another two weeks whether the prosecution will drop the most serious of four criminal offences he's facing. ' B% K3 r1 o/ s( P. `. J' w7 q2 J5 h

* B: O2 \& c! d2 K) bMr. Chen and two of his employees are facing charges of assault, kidnapping, forcible confinement and concealment of a weapon after they apprehended a man who had stolen from Mr. Chen's Lucky Moose market earlier the same day.   N) i( ?* G  x: w+ }

Anthony Bennett pleaded guilty to two charges of theft in August – one in relation to Mr. Chen's store, and another for stealing from a plant shop on King Street West. He got a lighter sentence for agreeing to testify as a Crown witness in the case against Mr. Chen, the store owner who caught him. ) F3 [+ U5 Q) ^0 l

9 e' g8 B5 b- c  v* B6 h6 WMr. Chen's lawyer Peter Lindsay said Thursday prosecutors have suggested Mr. Chen plead guilty to two of the counts – forcible confinement and concealing a weapon – and receive a suspended sentence and 18 months probation. , |: S. k. H- O4 u

3 T" P: q1 O3 y“There's no way, shape or form that is going to happen,” he told a swarm of reporters on the courthouse steps.

Mr. Lindsay has collected numerous affidavits from business owners in Chinatown and elsewhere in 52 Division, where the crime took place, saying Mr. Bennett, who has a criminal record dating to 1976 that includes theft and drug-related charges, has been stealing from their stores going back for years. 4 k0 d3 @: _$ K1 t, U- n' E# t

One woman said he stole from her store as recently as two weeks ago. 4 X# K; B1 ~5 y; m( W  N

Mr. Lindsay said he hopes the prosecution will drop the kidnapping charge, which was suggested as early as June. Because it's the most serious of the four and an indictable offence it would get Mr. Chen a jury trial – something Mr. Lindsay said he welcomes.

8 L$ B1 A# O) y8 @5 `Mr. Chen was surrounded in court by more than a dozen supporters – friends and members of Toronto's Chinese-Canadian community. One woman said she doesn't even know Mr. Chen, but she has helped raise more than $5,000 to support him.   e! q' F( B7 B! n' U; V  f

Mr. Chen said he doesn't understand why the charges still stand. He said having them hang over his head is hurting his business and his family of four. It doesn't help that his wife has an upcoming surgery next month, and he has been taking her to and from hospital in addition to running the store.

“It's affecting my business, my livelihood. ... Of course we're all worried.”

On May 28, Chen - who says he's waited on police for hours after reporting thefts - took it upon himself to capture the criminal.8 `+ R* ~& G8 `" e, Q$ `
His lawyer, Peter Lindsay, called Chen a "good, hardworking shopkeeper who tried to apprehend a criminal."" S+ g' `1 U0 M. s* K  h% O5 i
"(Chen) gets victimized and merely stops a shoplifter and restrains that shoplifter for somewhere between three or four minutes," Lindsay said outside court Thursday.& Q; z6 |1 Z% Y! ~" W# Y# N
"When police arrive, (he) throws open the van and says 'Here he is.' And Mr. Chen is being dragged through our criminal courts.": G) z4 J' z2 t1 o4 e
The case has put a spotlight on the debate over victim's rights and made Chen, a 35-year-old father of two young children, something of a hero in his Chinatown neighbourhood.
/ h0 k% b, ~! ?* w, f, i- n0 MSurveillance video from Chen's store, which has been uploaded on YouTube, shows a man stealing about $50 worth of plants. Anthony Bennett later admitted to taking the plants and selling them on the street for $2 each.
( {4 @2 K" W1 \, I; NAfter the thief fled the store, he allegedly stole flowers from another store a few blocks away, then returned to the Lucky Moose an hour later. When Chen tried to question him, the man fled.
8 W5 g  X7 p! w' R+ |; GChen chased him down, tied him up and put him in a van to await police, allegedly with the help of two employees.
  k5 o6 x3 _( X8 VUnder the Criminal Code, a person must find someone in the act of committing a crime for a citizen's arrest to be legal.
0 a  q4 l: O0 Y; @0 jIf the kidnapping charge is not withdrawn the case will be argued in front of a jury and a Constitutional challenge will be launched, Lindsay said.; o0 h3 A# \1 k6 y/ e# ~" Z% A4 r
"Arguably, under our current citizen's arrest, you can't arrest (the shoplifter) because he's not actually committing a crime, even though you have excellent evidence that an hour earlier he committed a crime, including store surveillance video that shows the whole thing," he said.0 r5 o; A: }1 O) Z; _
The case will resume Nov. 3, when the Crown is expected to announce whether kidnapping charges will be pursued.
! I/ l- v$ ]& kLindsay said that at a pre-trial meeting Thursday, the Crown refused to withdraw any of the charges, some of which he called "patently ridiculous."
9 K+ n) g% y( }"The carrying a concealed weapon (charge) is for having a box cutter, which a shop owner has to open boxes," he said.
' X. H; B& G" O"There's no suggestion the box cutter was used in any way, shape or form (in the incident)."
- x% i& ]  D. J( r/ y  @) [Bennett pleaded guilty to two counts of theft in August. The Crown wanted a 90-day sentence but offered him 30 days because he agreed to testify against Chen. With time served, he was out after 10 days.

"The bad guy says 'I'll help you to get the good guy,' and our court system gives him a pat on the head and says 'We'll give you a break,' notwithstanding your three-page criminal record."

H* b0 w- V) ~( G' zCourt transcripts from Bennett's trial corroborate the events that led up to the alleged attack - that Bennett rode up to the store on a bicycle, selected 10 plants and put them in a box on his bike and rode off "without any attempt to pay for the plants."! W  a6 Q) @/ I! R9 B: x  a
Bennett, 51, a father of six, has a longtime addiction to crack and a criminal history including a number of drug and property offences, court records show.
7 r1 `# G1 v! [6 ~/ m& p/ q2 C* PChen, speaking mostly through a translator, thanked his numerous supporters, adding that he is anxious about his fate and is under a lot of pressure. He called the charges unfair, saying he didn't wait for police to arrive because it took them six hours to show up the last time he called.1 G( ?+ G9 T$ m1 E* Q4 a$ |, C7 `
Const. Wendy Drummond, a spokeswoman for Toronto police, said theft calls are a lower priority, and get bumped further down if the suspect has fled. If the suspect remained at the scene, she said, it would increase the priority, even if the suspect is being detained by a shopkeeper.
5 u- u' }7 ^- }3 d5 Q0 h' ]! zChen's community started the Victims' Rights Action Committee after the charges were laid. More than $6,000 has been raised for Chen's legal defence.

"All we want is for the Criminal Code to work for the store owners and not for the criminals," said Chi-Kun Shi.3 _" m7 f& h# o% `( G3 h
Federal Immigration Minister Jason Kenney met with Chen at his store last month and said merchants should be able to use "reasonable means" to defend their property.

It might be an interesting topic to dicuss.

( w( M6 T. A1 J- }& I' ^5 R; F& MIt seems the police is very stupid to charge the the person who caught a thief, but on the hand of the story, the police is safeguarding the rights of common people from being violated with the excuse of private policing.
