《中华人民共和国国籍法》

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" f) Z; c2 {5 d5 e% H7 X  ^2 ?5 V. z    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
: g% h6 @6 [8 z  v/ E, x    第三条    中华人民共和国不承认中国公民具有双重国籍。, {- H1 ^! a4 n: E4 p( P
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
+ l' p! F+ N( w* \- C' |$ S3 _    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
" H/ q5 \! j5 E' Y* }    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
1 o) H7 y, w' X* f    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:4 s! k6 ]; F6 A7 ^+ Z" w
    一、中国人的近亲属;
& m% B  w! j) k4 H    二、定居在中国的;* M% l/ d' q5 ?& }
    三、有其它正当理由。
& h4 Y; n/ a9 h" T; @0 O3 {    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
& n. B, w9 G" c0 ?1 |    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。4 S9 I( ~% N& x: }: R
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:% [$ Y7 d" ^6 A" T
    一、外国人的近亲属;4 p1 }' q" a! B$ e$ r# P* U
    二、定居在外国的;, |; @/ [( W( t+ E& W6 }
    三、有其它正当理由。
6 ]& V8 h9 G: h) c, ~    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。5 t/ p& O9 R/ Y  A, h0 E( d
    第十二条   国家工作人员和现役军人,不得退出中国国籍。9 w8 G. i: }& c+ Z9 z+ s2 a. y
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。% a5 c$ D3 w5 G
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
: Y$ S% i' T# L6 K    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。- R" ^+ u, [1 {. w! k7 C
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。+ ~3 G4 {- L4 _* E3 Q) C
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

0 B# S* s$ c) Q5 _) k0 [+ C/ tThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of3 x2 V4 U( U0 s, g
nationality of the People''s Republic of China." P0 ^1 I& N. t- Y5 B; x" p
Article 2' n# k5 a! x) g( j- I
The People''s Republic of China is a unitary multinational  state;  persons. R, h5 B2 ?$ O/ F; P- U
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
9 f0 g5 {/ C+ H: z7 X& R0 l* X+ Rnationality.

6 }' x) m' t, fThe People''s Republic of China does not recognize dual nationality for any
8 C! p  s% w! [, Y. XChinese national." V- {/ B8 b# J
Article 4& M6 u8 u/ O, B8 V1 b! z9 a7 q7 E
Any person born in China whose parents are both Chinese nationals  or  one
7 T8 f9 @/ d0 Zof whose parents is a Chinese national shall have Chinese nationality.

4 y0 c* u( j! M+ g* s$ o. pAny person born abroad whose parents are both Chinese nationals or one  of& P( \, e8 \1 x, O1 d6 F7 ^; a
whose parents is a Chinese national shall have Chinese nationality. But  a
, ?& d: D6 Q: f4 Dperson whose parents are both Chinese  nationals  and  have  both  settled( [7 o1 O* y; E; I# ^2 g
abroad, or one of whose parents is a  Chinese  national  and  has  settled
- f; E+ F( |/ c8 `7 h3 R+ ^& habroad, and who has acquired foreign nationality at birth shall  not  have
9 M+ ^# ^! S/ T" o- X& GChinese nationality.
5 y  ?/ }& x8 P$ y' O& }. C* |/ w  J1 hArticle 6
' s, i+ |. p( Q( }* R5 w, T+ BAny person born in China whose  parents  are  stateless  or  of  uncertain/ Q0 o8 o% m  N8 C4 }" U5 Y8 q; t
nationality and have settled in China shall have Chinese nationality.
+ F% E+ H0 Q( w) O0 ]Article 7
+ j  o6 R8 ]! d; r. p3 UForeign nationals or stateless persons who are willing to abide by China''s4 W2 G# M: ^3 N) }4 o/ j
Constitution and laws and who meet one of the following conditions may  be6 G' |/ w6 Y3 a( f9 b7 a) u
naturalized upon approval of their applications:$ _! W9 L3 m6 L
(1) they are near relatives of Chinese nationals;7 K! ~& g% ?2 M  D
(2) they have settled in China; or/ }& P! N9 r/ ]8 {; a7 y; w
(3) they have other legitimate reasons.- q& m, t2 x5 H
Article 8% n5 e' X: _. r% [* L9 e
Any person who applies for naturalization  as  a  Chinese  national  shall% m; {# E6 d6 g2 N. t
acquire Chinese nationality upon approval of  his  application;  a  person9 b: ]" ^: t) h/ R+ J6 N7 K
whose application for  naturalization  as  a  Chinese  national  has  been: S4 Y2 M- u5 F
approved shall not retain foreign nationality.! K, G% R6 q8 M6 H
Article 97 I+ d1 `2 u, T" L* A( Z  H
Any Chinese national who has settled abroad and who has  been  naturalized
* v2 m, v8 w  b3 F* }as a foreign national or has acquired foreign nationality of his own  free
& B" W" Z/ T! Y# v! O4 w5 G) T% T6 Hwill shall automatically lose Chinese nationality.
8 a; m  j2 m( N, BArticle 10* s& J  R! E6 U, n
Chinese nationals who meet one of the following  conditions  may  renounce
3 s5 m$ U" e# n& }+ F  [- MChinese nationality upon approval of their applications:4 t7 ~. U- P+ a# g# H0 Z& T# x  K# F
(1) they are near relatives of foreign nationals;
2 K0 n5 ^# f; F: k- ?9 M6 b0 a; T(2) they have settled abroad; or
, h3 X$ f( k3 m, `4 a5 H(3) they have other legitimate reasons.+ S2 n2 g# k8 z+ X
Article 110 V2 `4 F* z0 n7 B+ h
Any person who applies for renunciation of Chinese nationality shall  lose
) R8 [: ?3 W9 F! XChinese nationality upon approval of his application.
; ?: t9 Z7 q2 q& l  SArticle 12
4 ]& z  N  U. hState functionaries and military personnel on  active  service  shall  not
- F; @* X  v" l7 C" `- A5 J! [renounce Chinese nationality.
2 h3 B  r+ m/ K. }Article 13# \5 @. {/ o7 f  u( g0 {2 @$ f+ z
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for: |; |! X, p% t7 _5 K, f5 J3 X
restoration of Chinese nationality if they have legitimate reasons;  those( {: W* \' C" s* [
whose applications  for  restoration  of  Chinese  nationality  have  been
8 \* M, |7 I5 I' m  ~/ Aapproved shall not retain foreign nationality.
  P: w2 W! Q- @% `7 }+ k# ]+ i: I, A  qArticle 14
/ w  f, {; H5 g: FPersons who wish to acquire, renounce or restore Chinese nationality, with
: L) q( l* f. N0 n- I; q- Sthe exception of the cases provided for in Article 9, shall go through the/ x* a) t* B+ {  ^
formalities of application.  Applications of persons under the age  of  187 ^6 s' w0 ?9 V4 k
may  be  filed  on  their  behalf  by  their  parents   or   other   legal* @+ I: R0 L2 r1 F/ T
representatives.
- U* \; I# Y( h8 i5 K! BArticle 15
  V' _- G! Y# J0 K" N, ~Nationality applications at home shall be handled by the  public  security" O. \& s2 E& N3 }5 @
bureaus of the municipalities or counties where the applicants reside;% Z6 ]+ Z) r7 G' E' D. `
nationality applications abroad shall be  handled  by  China''s  diplomatic/ B" s" Y+ w; K; l. v
representative agencies and consular offices.
/ v0 ~+ m+ O( h/ dArticle 16
$ n+ R- j) X  C; b  I) }Applications for naturalization as Chinese nationals and for  renunciation
) a; o( B8 V0 |- E, `& e" J- }or restoration of Chinese  nationality  are  subject  to  examination  and
' Y3 p/ S0 X, V; ]approval by the Ministry of Public Security of the  People''s  Republic  of+ U9 O% s. r/ j3 H# P: W; J
China. The Ministry of Public Security shall issue a  certificate  to  any
* t: z# m: d1 v0 R8 `+ C1 C/ Yperson whose application has been approved.+ h6 |" X' e8 A8 U- |# ^6 U: C
Article 171 ^3 A' g. _( a0 v- c! d6 ~$ ^: U! c
The nationality status of  persons  who  have  acquired  or  lost  Chinese
! ]1 j3 u2 }. ]nationality before the promulgation of this Law shall remain valid.
) D: r' z, y- v# b: H$ pArticle 18
3 c7 {- g- I9 F9 cThis Law shall come into force on the day of its promulgation.
